City of Montague Social Media Policy

This City of Montague Social Media Policy establishes the policies and procedures for the establishment and use by the City of Montague of social media websites (including but not limited to Facebook and Twitter) as a means of conveying City of Montague (“City”) information to its citizens and to others. For the purposes of this policy, “social media” is understood to be content created by individuals, using accessible, expandable, and upgradable publishing technologies, through and on the Internet. Examples of social media include, but are not limited to, Facebook, blogs, Myspace, RSS, YouTube, Second Life, Twitter, LinkedIn, Delicious, Pinterest, and Flicker. A “City social media site” is a City-run profile on a social media website.

The intended purpose behind establishing City social media sites is to disseminate informal information from the City, about the City and City events, to its citizens and to others. City social media sites are not intended to be administered, nor are they administered, as official City websites. The official City website is http://ci.montague.ca.us/. The official City website remains the City’s primary and predominant internet presence.

Policies, Procedures, and Terms of Use

1. No City social media site shall be created until that City social media site is approved by the City Council.  

2. A single City Council member and a single City employee, and no other person or electronic entity, shall administer all City social media sites (“Site Administrators”). Site Administrators are subject to approval by the City Council.

3. City social media sites shall make clear that they are maintained by the City of Montague and that they follow the City’s Social Media Policy. In addition, the City’s Social Media Policy language shall be placed, in its entirety, on the City’s official website and on each City social media site where the language can be reasonably posted. If the City’s Social Media Policy cannot be reasonably posted on a City social media site, then a web link to the language must be placed on the City social media site. If neither the City’s Social Media Policy nor a web link to the City’s Social Media Policy can be placed on the social media site, then the City shall not maintain that social media site.

4. Wherever possible, City social media sites shall host a web link back to the official City website for forms, documents, online services, and other information necessary to conduct business with the City.

5. It shall be the duty of Site Administrators to monitor content on City social media sites to ensure adherence to the City’s Social Media Policy.

6. Site Administrators will administer City social media sites such that only Site Administrators, and no other person or electronic entity, is allowed to comment on the City social media site. For the purpose of the City’s Social Media Policy, “comments” include information, articles, pictures, videos, assent of approval or disapproval, or any other form of communicative content posted on a City social media site. The City intends to run its City social media sites to disseminate informal information from the City, about the City and City events, to its citizens and to others. The City does not intend to operate or maintain City social media sites as a forum open to public comment. The City shall consult its City Attorney prior to changing any terms or any policies encompassed by this paragraph.

7. Site Administrators shall not make any comment on City social media sites on a matter in which they know or have reason to know a Site Administrator has a financial interest. A Site Administrator has a financial interest if it is reasonably foreseeable that the comment will have a material financial effect, distinguishable from its effect on the public generally, on the Site Administrator, or a member of his or her immediate family. Notwithstanding the foregoing, a Site Administrator may make a comment on a City social media site on a matter in which they know or have reason to know a Site Administrator has a financial interest, if the Site Administrator (1) places the proposed comment for consideration before the City Council; (2) on consideration, publicly identifies in detail the financial interest that caused the conflict (except that he or she need not disclose the street address of a residence); (3) recuses himself or herself from discussing and voting on the matter; (4) leaves the room until after the decision regarding the matter has been made, unless the matter is on the portion of the agenda reserved for uncontested matters; and (5) is informed by the City Council that he or she is allowed to make the comment on the City social media page.

8. City social media sites are subject to the California Public Records Act. Any content maintained on the City social media site, including a list of subscribers, posted content and comments, and any emails or private messages associated with the City social media site, may be a public record subject to public disclosure. Site Administrators shall maintain records of all content maintained on the City social media site, including lists of subscribers, posted content and comments, and any emails or private messages associated with the City social media site.

9. All City social media sites shall adhere to applicable federal, state and local laws, regulations and policies.

10. Site Administrators representing the City government via City social media sites shall conduct themselves at all times as a representative of the City and in accordance with all City policies.

11. Site Administrators shall monitor City social media sites for emails or private messages requesting response from the City, and shall provide all such requests to the City Clerk for response. Notwithstanding the foregoing, Site Administrators shall post, in a conspicuous place on all City social media sites, a short statement that the City social media site is not intended to be used to request assistance or response from the City, a short statement that water and sewer emergencies should be reported by calling 459-3030, and a short statement that emergencies should be reported by calling 911.

12. Site Administrators shall not reveal or use the name, image, likeness, or otherwise reveal the identity of any City employee unless the Site Administrator has written consent from the City employee to reveal the name, image, likeness, or otherwise identify the City employee.

13. All comments posted to any City social media site are bound by that social media website’s Terms of Use or Statement of Rights and Responsibilities. For Facebook, these can be found at http://www.facebook.com/terms.php.

14. All social media websites through which the City may maintain a City social media site are owned and operated by third party entities not affiliated with the City. The City does not endorse in any manner the content, including advertising content, placed on the City’s social media site or on the borders of the City’s social media site by the social media website or by other third party entities. The City only endorses those comments made by the Site Administrators on City social media sites.
